DYNASTY OF DISASTER?(The last days of the so called pro-opposition’s era in UIAM)

After almost all the seats have been won uncontested while the remaining still vacant, the most astonishing and remarkable inference is the falling down of so called pro opposition’s Students’ Representative Council of IIUM. It was quite along journey for them behind almost a decade being at the top there. Yet it is very attention-grabbing to find that their trip over was neither after have been defeated nor after been given a pink slip from university. The outcome was due to their own self- initiated move to boycott. Subsequently the other candidates from the other camp acquire the vacancies left behind. It seemed that the say-so is quite in high spirits to observe this undersized revolution.

As the years rolled, even though coming from the similar base camp, their trends and approaches are variety and erratic, the most favorable may be during Muhtar Suhaili’s tenure even was popped in by couple of protests such as regarding to one way road. A number of the leaders also come from the law faculty, except 3 presidents includes Muhtar. It is also not once in a blue moon to find that fact right? As our former PMs are also almost the legal eagle bigle, except Tun Mahathir and Pak Lah.

THE BOYCOTT


The still-on boycott also a big task for them as well as, in fact it is seemed to be tougher than operating an ordinary lawful campaign to win the election. Moreover, the IIUM rules put a crystal clear that student strictly is not allowed to organize such kind of protest. According to them, the public is still uninformed about the reason behind the boycott. The requirement of 2.8 CGPA which is applied to the potential candidate is not a big issue for them. Nevertheless the mainstream media has manipulated and keep bringing up that it was the main ground of their boycott. The rule is the angel side of over all regulation, but the other side of the coin is shocking. They claimed that it full with ambiguity and probability of biasness

To the new appointed line-up besides celebrating the historically victory, you also have to save your breath for the upcoming court decision which is still proceeding. You also must bear in mind that you are not purely elected by students. Hence it is better for you to prove that your existence there is to represent the interest of students not any other group, unless it will be exactly the same like as what you have accused the previous line up. Now is your turn to demonstrate that you are colorless and not belong to any political party. If you fail to do so, the one year tenure, shall be a honeymoon or warm-up period for the other camp to grab back the seats. In what ever situation just mind that Rome is not built in ‘one year’.

P/S: Personally, I'm waiting for Pro-University group who struggle for the vision and mission of University, which include Islamization, Internationalization, Integration and Comprehensive Excellence.

THANK YOU FOR BEING EXTREMELY APPRECIATIVE!

Yesterday (Monday), it was not a very blissful morning as it began with a farewell call from my buddy who was leaving to Hong Kong for a week vacation. Shortly, received a SMS from a pal:

“Ok dis is something new? The Law Student Soc at 2nd level has been tarnished in such a way dat d pic kena conteng..Whoah! A bit too much rite?”

Subsequently, I discovered almost all the photos of LAWSOC’s excos has been tarnished and doodled(conteng). Earlier, some photos were missing and a number of our programs’ banners also have been scribbled, but we were still patient enough to stand for all those monkey businesses. But at this time, this kind of vandalism evil doing turn out to be worst. The first reflection crossed in my mind is the act of that immature and extremist political group in the campus, plus a signal that the election is just around the corner.

The most depressing and intolerable is the office barrier i.e. LAWSOC’s excos never made any statement or gesture that linked us to any political group, in fact none of us happen to be a candidate for this upcoming election. One can not jump into straightforward conclusion that we are apart of any political group due to petite number of us who involve indirectly with certain movements. Indeed, it is a promised fundamental right for every single one of us in Federal Constitution of Malaysia, please refer to article10; freedom of speech, assembly and association. Save for, the students should never take for granted the University and University College Act (AUKU), yet one may still argue that UIAM is not bound to that controversial act since it was registered under Company act 1965, measure up to other public university in Malaysia. Again it is a grey area of law. Hence the act of taking legal action against university might be justified, inter alia, in order to have a crystal clear about related ambiguous position of law. However for the time being, I'm ill-equipped to present further comment on that very up to date issue in campus.

Back to the present ruined mood incident, I strongly agree with Sis Martineli’s (from Student Developement Unit IIUM)words that we deserve to get appreciation in doing social works but we do not demand or claim for it. Al-Banna once ever supposed, we are like a fruity trees, people throw stones towards us, but we throw back the sweet fruits to them. This unpleasant incident in my point of view is just a nine days’ wonder, plus not every student cares about society and political issues. To those who have committed, just bear in mind, I' going to save my breath for this CHILDISH matter as I was not born yesterday. Soon or later I will find out who you are!


P/S: Annual General Meeting of LAWSOC is just around the corner as well, it might be during Ramadan, and with a bit of luck it will be the most blessed AGM after all.

The Freedom of Malaysian Bloggers and the Law (A moment with Jeff Ooi and Sonia)

Attending a workshop organized by SEACeM (Southeast Asian Centre for e-Media) on 24th September 2005 upshots a new turning point for me in blogging. The workshop on the whole is about writing for internet. The eminent Malaysian blogger, Jeff Ooi and Sonia, a representative from Centre for Independent Journalist Malaysia were the speakers. It’s more alike a dialogue and sharing moment as only a petite group of people involved. I have a preference to be present in this kind of program to a certain extent rather than in a big intellectual discourse whereby there is only one way of communication.

The discussion is also a redefining moment to my perception toward all those independent bloggers like Jeff Ooi. Up to that time, I supposed most of them are government’s antagonist and the new generation of extremely liberal young chauvinists Malaysian who for ever and a day demand for rights and equality. It is exactly incorrect as in fact Jeff Ooi from the very beginning put in plain words that he is not human right activist or representative any NGO but always promotes the positive usage of internet. He simply raises the issues that amount to frustration and disturbance in the society.

Sonia (Left)

The further outcome as the law is concerned; Sonia supposed that the bloggers are bound to The Communication and Multi Media Act, Sedition Act, Defamation Act and OSA on top. She claimed that the offence which falls into the sedition act is a strict liability offence. There shall be no defense at all availably to the accused. With due respect, I still believe that general defenses laid down in Chapter IV are applicable to this offences. Section 6 of Penal Code point out that the every offence shall be read subject to the chapter 4.The Chapter provides general exception, such as defense of mistake and accident. The word offence in the Penal Code as well denotes to any act punishable under any other law for the time being in force. However, as there are numerous grey mootable areas of law particularly in the case relating to strict liability offences, nobody can claim without doubt that the defenses is always there for you. Not a single soul ever been accused ever been charged under Sedition Act as regard to blogging. As the result, this unprecedented situation is crucial to be pondered.

Another legal issue raised in the discussion, is the suggestion made by Jeff Ooi that the any offence concerning to personal blogging should be governed only under Communication and Multi Media Act. Despite the fact that the act itself put more concern to the commercial website rather than personal weblog. Conversely, from my point of view, it is depend on the offence which is committed by bloggers. If the act is clearly seditious and malicious, there is no wrong to charge them under the Sedition Act even sad to find that the sedition act put a room for wide interpretation of act amount to sedition and incitement. For example, what kind of act comes to seditious tendency as is mentioned in the provision? We should bear in mind as well that according to our statutory a different 2 person who committed precisely the same crime might be charged under different provisions. For example in the case of murder and culpable homicide under section 299 and 300 of Penal Code, which is turn out to be questionable and arguable, just refer to conflicting views between Mayne and Stephen. By appreciating the situation, the matter is now absolutely under the discretionary of the prosecutor and the say-so.

As the blogging is the new-fangled trend among Malaysians, this medium should be mobilized wisely and positively. This mode of expression is also less control by the laws. Certainly, it renders to pro and cons. Apart from being a conducive breathing space for freedom of expression, on the other side of the coin it also invites some irresponsible and corrupted culprits. Therefore, bloggers should promote the positive practice in the site and preserve their weblog from cyber criminal offender. The recent case clearly prescribes this problem, the weblogs belong to Mack Zulkifli and Peter Tan have been tarnished by malicious and racist messages in the comment boxes provided for readers. There have lodged a police report. Yet, it is reasonably irritated and anxious to wait for the government’s action that shall be initiated consequently to handle this problem. More often than not, the government will bring into play the law as the tool to overcome any mischief. With a bit of luck, another up-to-the-minute law will not be drafted in order to uphold the freedom of expression as the mainstream media at the present are no more favorable for that particular fundamental right. In my viewpoint, the current provision is sufficient in coming to grips with the excessive conduct of cyber abuser.

Synopsis Filem

Lando (Ricky Hanggono) seorang fotografer yang baru saja ditinggal tunangannya. Dalam kegalauannya ini dia bertemu dengan seorang gadis penjaga ticket busway yang bernama Kalin (Dian Sastrowardoyo). Lando pun kembali menemukan gairah hidupnya. Tapi hal ini tidak berlangsung lama, karena tanpa alasan yang jelas Lando meninggalkan Kalin begitu saja, yang membuat Kalin marah dan sakit hati.

Waktu terus berlalu, Lando yang tetap dengan kegalauannya mendapatkan Kalin sekarang telah menjadi seorang super model, dia melihat kehadiran kalin dimana-mana.

Timbul kerinduan dan keinginan untuk menemui Kalin kembali dan menjelaskan alasannya dulu pergi. Akhirnya kesempatan itu didapatnya, dia berhasil menemui Kalin, tapi lagi-lagi pertemuan ini berakhir dengan tragis karena Kalin mengalami kecelakaan dan mengakibatkan dia buta. Walaupun kemudian Kalin mendapatkan donor untuk kornea matanya yang membuat dia bisa melihat kembali, tetapi dia tidak melihat kehadiran seorang Lando, laki-laki yang sebenarnya sangat dia cintai.

Bisakah Kalin akhirnya bertemu dengan Lando, atau apakah kornea mata itu?? Begitu sempitnya waktu, begitu besarnya cinta !!



P/s: Cinta seperti menunggang basikal, sekali kita tahu menunggang kita takkan lupanya, biarpun sakit setiap kali jatuh namun,kita takkan serik untuk mencuba lagi...

It’s undeniable that xxxxx (deleted) are stupid, lazy and incapable. Why don’t they just humbly admit the facts and repent and learn from other races especially xxxxxxx?

Drug abuse, hate, incest, liberal extremism (culture of miniskirts and gay marriages), murder, racism, rape, religious fanaticism, parochialism, snatch theft, spoilt-bratty behaviour, tribalism, wife abuse, child abuse, all that is associated with the xxxxx race.

The xxxxx race is the biggest impediment towards building a truly Malaysian nation, and should be chucked into the dustbins of history.

Negara Pattani Merdeka and Malaysian-Malays


Kepulangan ke hometown Perlis agak tersentuh bilamana dalam suasana kita baru sahaja menyambut ulangtahun kemerdekaan, namun saudara kita sebangsa dan seagama di Wilayah selatan Thailand masih lagi dibelenggu dengan ketakutan dan kesengsaraan. Kedatangan singkat dengan saudara penulis dari Songkla juga menimbulkan tanda tanya kerana beliau dalam keadaan tergesa-gesa ingin bertemu dengan individu tertentu.Penulis melalui sebelah ibu berasal dari kg Chena, Wilayah Songkla,tetapi tidak tahu bertutur bahasa siam.Penulis tidak rasa ianya penting kerana Wilayah Songkla adalah tanah Melayu dan penulis bebas bergerak di sana tanpa bertutur dalam bahasa siam.


Dilaporkan semenjak kancah bermula iaitu selepas peristiwa Tak Bai dan serangan biadap ke atas Masjid Kg.Kersik, seramai lebih 900 jiwa tidak berdosa telah gugur ke bumi.Mereka terasing di bumi sendiri, akhir terpaksa mencari perlindungan di bumi saudara Melayu-Islam yang kadangkala tak begitu perihatin terhadap nasib bangsa di Thailand.Melalui berita tengah hari tadi seramai lenih 130 pelarian,telah ditahan di depo tahanan pendatang tanpa izin. Seramai 40 daripadanya adalah kanak-kanak, mereka mendakwa bahawa sebahagian nama mereka telah disenaraikan tanpa bukti telah terlibat dalam kegiatan militan dan anti-kerajaan

Melayu-Malaysia Tak Prihatin


Malam merdeka yang lalu, selepas tersentuh dengan iklan Petronas yang sinis terhadap bangsa Melayu.Buletin utama melaporkan masalah yang berlaku Komplek Perniagaan Padang Besar berhampiran sempadan yang dimonopoli oleh peniaga 'asing'.Penulis tidak bersetuju dengan pemberita TV3 yang mengecam sikap sambil lewa kerajaan Perlis yang tidak mengambil tindakan terhadap isu itu.Penulis melihat ini dari sudut yang lain memandangkan kita kena siapa yang dimaksudkan sebagai peniaga asing itu, mereka adalah peniaga Melayu Thai yang datang menumpang kemakmuran negara saudaranya setelah dianaktirikan dibumi sendiri.Tambahan pula penduduk tempatan sendiri yang menyewakan premis perniagaan tersebut kepada mereka.Inilah kesan idea dangkal dan sempit negara bangsa, mereka merasakan hanya warganegara yang berhak untuk segala, sambil mengesampingkan isu kemanusiaan, parktikal dan sentimen bangsa. Benarlah kata Sasterawan negara, Almarhum Usman Awang dalam puisinya SALAM BENUA:

Mereka merompak kita dengan undang-undang

Muqreez strongly agree with Tun Mahathir's proposal for an autonomus status for Patani is one of the solution to settle the Malays grievances because it is hard for muslim state to obtain independent nowadays.History has proved that by giving the Malays the right to administer themselves but within the same fence (Thailand), peace would prevail. Rama III and IV had proved it right, then why don't we strive for Tun Mahathir's proposal? If not, as warned by Anwar Ibrahim after the incident of Tak Bhai, the deep south could become a breeding ground for extremists....

P/S:Muslim minorities are never allowed to speak of autonomy, and anything resembling some form of self-governing, and are frowned upon, condemned as divisive, dissident and treason BUT not if they are whites of Africa, Christians, Jews, Hindus, Buddhists or some other minorities as long as they are NOT muslims
